Terms of Use

1. Purpose

These Terms of Use (the “Terms”) govern the use of the Lyrics Setlist mobile application (the “App”), published by Lostin70s Audio (the “Publisher”).

The App is a personal tool that allows users to create setlists, manage songs, display lyrics and import LRC files.

2. Acceptance

By downloading or using the App, users acknowledge that they have read and accepted these Terms. Users who do not accept them must not use the App.

3. Use of the App

Users agree to use the App lawfully, fairly and in compliance with third-party rights. They are solely responsible for the data, text, lyrics, LRC files, setlists and other content they create, import, store, display or use through the App.

4. Lyrics, LRC files and intellectual property

Song lyrics, translations, synchronisation data, text and other content may be protected by intellectual property rights.

Users warrant that they hold the rights, authorisations or licences required to import, reproduce, store, display or use content they add to the App. The Publisher does not provide a lyrics catalogue and does not guarantee that imported or searched content is free to use.

Users must not use the App to infringe copyright, related rights, trademarks, image rights or any other third-party rights.

5. Search through a custom URL

The App allows users to enter a custom search URL. That URL is selected, configured and used under the user’s sole responsibility.

Before using this feature, users confirm that the selected service, its API and the content it provides permit their intended use, including the display of lyrics. The Publisher does not control the third-party services selected by users, their availability, security, terms of use or content.

6. Importing LRC files and backups

The App may import LRC files selected by users. Users are responsible for their source, legality, retention and backup.

Users are also responsible for backups they export or import. They must protect their devices and files against unauthorised access, loss or alteration.

7. Free version and Pro in-app purchase

The free version of the App is limited to one setlist and fifteen songs. The non-consumable Lyrics Setlist Pro in-app purchase unlocks unlimited setlists and songs.

Purchases are made through the App Store and are subject to Apple’s terms. Payments, refunds and payment methods are managed by Apple; the Publisher does not access users’ payment data. Users may try to restore purchases from the App settings when that feature is available through the App Store.

8. Availability and liability

The App is provided “as is”, to the extent permitted by law. The Publisher endeavours to ensure its proper operation but does not guarantee uninterrupted availability, error-free operation, compatibility with every device or suitability for a particular purpose.

To the extent permitted by law, the Publisher cannot be held liable for content added by users, third-party services configured by users, unauthorised use of the App or data loss resulting in particular from a user’s failure to back up data.

9. Changes and applicable law

The Publisher may change the App and these Terms. The online version, dated with its latest update, is the applicable version.

These Terms are governed by French law, subject to mandatory rules applicable in the user’s country of residence.

Privacy Policy

1. Data stored locally

The App stores the data needed for its operation on the user’s device:

songs, setlists and lyrics entered or imported by the user;
imported LRC files, as synchronised lyrics content;
App settings, including the custom search URL;
the Pro purchase status, verified with the App Store.

This data is stored locally on the device. The App does not create a user account, and the Publisher does not operate a server to collect or centralise this data.

2. Searches through a custom URL

When users perform a search, the App sends the query they entered to the URL they configured. The App automatically adds the /api/search path when necessary.

The relevant third-party service may have its own privacy policy and terms of use, which users should consult before using it. The Publisher does not control the practices of those third-party services and does not receive, through the App, queries sent to the URL selected by the user.

3. Import, export and in-app purchases

LRC files and backups are selected by users. They are read or written locally at the user’s request. The App does not send them to the Publisher.

In-app purchases are processed by Apple through the App Store. The Publisher does not collect or store card details or other payment data.

4. No advertising or tracking

The App does not include advertising, advertising tracking, third-party analytics tools or user accounts.

5. Retention, rights and contact

Data remains on the user’s device until it is deleted, the App is uninstalled, or it is replaced through an import. Users are responsible for protecting their devices and backups.

As the Publisher does not centralise App data, local data can be managed directly in the App by deleting content or uninstalling the App. For any questions about this policy, contact contact@lostin70s.com.

6. Changes to this policy

This policy may be changed to reflect changes to the App or legal requirements. The last-updated date will then be amended.
